ENGLEWOOD – Taylor Sherrill, 18, of Butler Township, has been charged with two counts of sexual assault stemming from an incident in a home on Wenger Road. Englewood police allege that Sherrill took advantage of an 18-year old female who was intoxicated.
The incident occurred in the late evening/early morning hours of May 29-30 at a party being held at the residence. Police say that Sherrill and the victim had met at the party and neither lived at the residence. Sherrill had just graduated from Butler High School earlier in the evening of May 29, however it is unknown whether he attended the commencement exercise.
The incident was reported to police on June 1.
Sherrill was charged with two counts of sexual assault, both third degree felonies. One of the charges stem from what police believe was the victim’s significant impairment by alcohol which made her unaware of one of the sex acts.
“The victim was intoxicated to the point that she could not give consent,” said Englewood Police Sergeant Mike Lang. “Both (sexual assault) charges stem from the same incident but are two different legal ways of looking at what happened.”
Lang said that the assault was stopped by others at the party.
“They were all outside and other people at the party became aware that the victim was in a tent with the guy and ordered them out of the tent,” said Lang. “They knew something was going on and knew it wasn’t right.”
Englewood police say the alleged incident is still under investigation, but enough evidence has been gathered to enable them to obtain an arrest warrant for Sherrill. He was arrested on Friday, June 4 and has since been released on bond.
Sherrill was arraigned in Vandalia Municipal Court on June 8 and a preliminary hearing originally scheduled for June 12 was bypassed. Lang said that the case would be presented to the Montgomery County Grand Jury on that date.
